MSCHF’s Wavy Baby sneaker from last year has ruffled the feathers of more brands than Vans. The Brooklyn-based art collective has been hit with another lawsuit over the riff on Vans’ Old Skool, this time by the streetwear label WaveyBaby.
In a suit filed last week, WaveyBaby accuses MSCHF and its CEO of trademark infringement, unfair competition, and civil conspiracy. The company obtained registration for the WaveyBaby name in 2021 and says it sent a ceast-and-desist to MSCHF immediately upon learning of the sneaker with a similar name, according to The Fashion Law. The two parties exchanged several letters but weren’t able to come to an agreement before MSCHF released its Wavy Baby sneaker in April 2022.
WaveyBaby claims MSCHF’s use of the name is “likely to and in fact already [has] caused harm due to [MSCHF’s] use of a confusingly similar name to [its] trademark” and argues that the ongoing lawsuit with Vans has only made matters worse. As a result, WaveyBaby is seeking an injunction to prevent MSCHF from “advertising, marketing, promoting, offering for sale, distributing, or selling the infringing Wavy Baby shoes” in addition to monetary damages.
