MSCHF has another lawsuit on its hands.
Following the artistic label’s legal battle with Nike over the “Satan Shoe” in 2021, MSCHF has another trademark lawsuit on its hands.
In April, MSCHF announced its latest creative effort in partnership with Tyga. The MSCHF “Wavy Baby” sneaker soon sparked interest with its polarizing design from the literal wave shape of the shoe to its packaging. On April 14, Vans, Inc. filed a trademark lawsuit against MSCHF and its Wavy Baby sneaker ahead of the shoe’s April 18 release.
According to court documents, Vans claims that the shoe is “a direct effort to confuse consumers, unlawfully siphon sales from Vans, and intentionally damage Vans’ valuable intellectual property rights.”
Additionally, Vans claims that MSCHF’s sneaker, packaging, branding, and labeling are “an unmistakable attempt by MSCHF to freeride on the goodwill Vans has earned through the iconic, wave-like SIde Stripe Mark.”
The lawsuit states that Vans motioned a cease & desist letter to MSCHF on April 6.
MSCHF states that it still pans on releasing the sneaker. MSCHF also claims in its statement that Vans sought to obtain 50% of the sales profits along with a handful of Wavy Sneaker pairs., according to WWD.
